OK, so Eastern Cape judge president Selby Mbenenge denies sending judge’s secretary Andiswa Mengo a WhatsApp image of “Long Tom”, which she told a judicial conduct tribunal this week was a picture of his penis.
But that’s just the “highlight” in an 18-month-long interaction with the persistent judge, which the 37-year-old single mother claims showed “he is someone who just does not listen when I say ‘no’.”
Mbenenge contacted her at all hours of the day and night with messages that contained sexual innuendo. His story is that his advances were “flirtatious” but consensual.
Quite how a judge in a top court is unable to discern the power imbalance at play in this case is beyond the reach of everyday jurisprudence.
Pity the poor women who have ever had to tell their stories to this mampara judge. It’s a case where he must be regretting that there wasn’t a cover-up.
